​Con-X, developed by e-merge data solutions (a Wells Group company), complies with the New Zealand Privacy Act 2020 when dealing with personal information. Personal information is information about an identifiable individual (a living person, not a legal entity). This policy explains how we will collect, use, disclose and protect your personal information when you use Con-X field mobility software. This policy does not limit or exclude any of your rights under the Privacy Act 2020. For further information on the Privacy Act 2020, see www.privacy.org.nz

Changes to this Policy

We may change this policy by uploading a revised policy onto the Con-X platform or our website (www.con-x.com). The change will apply from the date that we upload the revised policy.

Who do we collect your information from

We collect personal information about you from the following sources:

  • You, when you provide that personal information to us, including through the Con-X mobile application, web portal, registration or subscription process, through any contact with us (e.g. telephone call or email), or when you use our software and services.

  • Your employer or organisation that has engaged Con-X for field service management.

  • Third parties where you have authorised them to use your information in such manner.

  • Any source that is publicly available.

What personal information do we collect

Personal information that we collect and use may include the following:

  • Your name and contact information.

  • Employment details and organisational information.

  • Location data collected through the Con-X mobile application when performing field work.

  • Job site information including property addresses and customer details.

  • Digital signatures and timestamp information related to job completion.

  • Photos and documentation uploaded through Con-X for job verification and record-keeping.

  • Device information and technical data from your mobile device or computer used to access Con-X.

  • Login credentials and user activity within the Con-X platform.

  • Work records, job completion data, and compliance documentation.

  • Any other information required for the completion of field services that you or an authorised third party have engaged us to support.

How we use your personal information

We will use your personal information:

  • To verify your identity and authenticate access to Con-X.

  • To provide field mobility software services to you and your organisation.

  • To enable job management, compliance tracking, and reporting functionality.

  • To facilitate communication between field workers, administrators, and customers.

  • To process and verify work completion and compliance records.

  • To enable integration with third-party systems and service providers as configured by your organisation.

  • To improve the software and services that we provide to you.

  • To provide technical support and training.

  • To bill your organisation for services and collect payments owed to us.

  • To conduct surveys, research and statistical analysis to enhance Con-X functionality.

  • To protect and/or enforce our legal rights and interests, including defending any claim.

  • For any other purpose authorised by you, your organisation, or as permitted by the Privacy Act 2020.

Disclosing your personal information

We may disclose your personal information to:

  • Other companies or business units within the Wells Group.

  • Your employer or organisation that has subscribed to Con-X services.

  • Contractors, subcontractors, or service providers who are completing jobs managed through Con-X.

  • Third-party systems and service providers as part of integration processes configured by your organisation.

  • Third parties that support our software services, including any business or person that hosts or maintains any underlying Information or Communication technology system(s), cloud infrastructure, or data centre that we use to provide Con-X.

  • Any regulatory authority or agency who can require us to supply your personal information.

  • Any person, business or entity authorised by you or your organisation.

  • Any other person or entity authorised by the Privacy Act 2020 or any other law to comply with our legal obligations.

Note: Any third party that supports our services and products may be located outside New Zealand. This may mean your personal information may be held and processed outside New Zealand. Where this is the case, we perform due diligence to ensure the third party is compliant with and/or operates in a manner that is aligned with our privacy expectations and the NZ Privacy Act 2020.

Security of your information

We implement industry-standard security measures to protect your personal information stored within Con-X, including:

  • Secure data encryption during transmission and storage.

  • Access controls and authentication mechanisms.

  • Regular security audits and updates.

  • Secure cloud infrastructure with backup and disaster recovery procedures.

While we take reasonable steps to maintain secure connections and protect your information, the transmission of data over the internet carries inherent risks. Users should ensure their devices and login credentials are kept secure.

Correcting or removing your personal information

Subject to certain grounds for refusal set out in the Privacy Act 2020, you have the right to request a correction to or removal of your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

In respect of a request for correction, if we think the request is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

In respect of a request for removal of your information from our systems, if we are reasonably able to remove the personal information, we will do so. Please note that:

  • If this information has been provided to us by your organisation or third parties, they may subsequently resubmit this information to us, which is beyond our control.

  • Removal of your personal information from Con-X may impact the software functionality and reporting we can provide to you and your organisation.

  • Certain information may need to be retained for compliance with legal and regulatory obligations.

Your request should provide evidence of who you are and set out the details of your request (e.g. the personal information and the correction or removal that you are requesting).

While we take reasonable steps to maintain secure connections through the Con-X platform, if you provide us with personal information over the internet or mobile networks, the provision of that information is at your own risk.

If you follow a link within Con-X to another site, the owner of that site will have its own privacy policy relating to your personal information. We suggest you review that site's privacy policy before you provide personal information.

Con-X may use cookies and similar tracking technologies to monitor your use of the platform and improve user experience. You may adjust settings on your browser or device, although this may mean that you cannot use all of the features of Con-X.
